It was a huge win for sony having the rights exclusively.

I'm sure this isn't right. Sony have a licence to use Spider-Man but if it was exclusive no other games could use Spider-Man yet Lego superhero games - which include a bunch of Spider-Man IP - are still on sale (unlike Activision's lapsed Spider-Man games) and several Spider-Man skins are in Fortnite. None of this supports the claim that Sony has any kind of exclusive rights to the IP.

Marvel would not be so foolish to exclusively licence such a popular IP to one videogame company.

This is just for a main game, not for the whole franchise, which Microsoft rejected when they were the ones approached first. So this doom and gloom about Sony "stealing" and "keeping Spiderman away from competition" is simply not valid

After a bunch of Activision miminal-effort Spider-Man games, Marvel would be alert to the risk of allowing any one company to have an exclusive licence in any area of media. It's also just not Disney's way. Licences for everybody, let everybody give them money... just as the Mouse would want!

OMG not this again! Insomniac chose Spider-Man from Marvel's complete roster; it had nothing to do with Sony owning gaming rights which they don't own. Marvel approached Sony to make a Marvel hero game. Sony gave the job to Insomniac. Insomniac chose SM (for obvious reasons). But licensing deals has nothing to do with this title and it could have been a Hulk or Iron Man game...

“Long story short: Sony came to us and asked if we wanted to work with Marvel. Sony and Marvel let us decide what character/universe we wanted to make a game based on. We chose Spider-Man,” he said.

Additionally, that was the agreement to make Marvel titles before SM was decided upon. Again, as above, Marvel went to Sony (and MS) and asked for a AAA company to make high-tier games for them. Sony agreed. Sony approached Insomniac and said, "what do you want to make?" Price chose SM. Sony developed the game in agreement with Marvel for a new AAA Marvel-IP title.

(This is actually contradicted in the quoted source that says Sony chose SM and approached Insomniac to make it. That isn't supported by the quotes though and seems to be inferred by the author.)

This is all completely independent of Sony's movie rights and Sony have zero game licensing deal for the SM IP as far as we know (and we would know because it'd be a big deal broadcast to investors). Subsequent PS exclusives are either one-off agreements or good-faith agreements - there's no financial record of Sony securing rights. And evidence like PS exclusive SM skins for Fortnite are shown to no longer be valid with the latest cross-platform SM skins. The previous Fortnite exclusive skin was a Tom Holland movie tie-in, not a Marvel/SM creation.

Bro it doesn't matter if Insomniac chose spider-man or not. once they choose spider-man then it became exclusive to sony. Now when contracts come up maybe that changes but for now Sony has exclusive rights to making Spider-man games (can still apear in other marvel properties but not as the main character)

Why is this an issue especially the directed at Sony part?

If Apple/Google grants me exclusive access to the iphone/Android, would it be my fault that you have to go back to Blackberry/WinMo? Or is it the fault of the companies that actually owns the products?

Why is Sony obligated to look out for gamers who exist outside their userbase?

But it's not. There was no exclusivity deal. There can be other Spider-Man games on other platforms depending on what Marvel want to do. The lack of SM elsewhere is because Marvel hasn't pursued that (perhaps not wanting to water down the IP). Obviously Sony could choose to cross-plat their title but they were leveraging it for platform value at the moment; now it is coming to PC.

So then Sony has a defacto exclusivity deal on Spider-man since Marvel isn't licensing it out to anyone else.

No, there is no deal. A deal requires an agreement to limit the IP, which doesn't exist. Sony are not involved in any way in the availability of SM on other platforms. You can no more blame Sony for the lack of SM on XBox as you can blame them for the lack of a new X-Men game or Rescue Rangers game or Disney Princess Adventures game - it's entirely up to Disney to reach out and get these games produced on whatever platforms they want them on.

Cool, can I have a copy of the contract then to view

So you're content adopt to a view without sight of a contract but unable to accept a different view - one which is supported by evidence - without sight of same contact?

This may be true in a general IP context, but they are involved in the availability of the Spider-Man games they recently published, as well as the getting an exclusive deal for Spider-Man DLC for Marvel's Avengers. So they have locked down 2 games and DLC for a third game involving the character.

So, it's finally happened, due to supply constraints worldwide estimates now have XBS consoles selling better than PS5 consoles for 2022.

2022 world wide year to date unit sales:
  • PS5 - estimated 3.48 million units
  • XBS - estimated 3.55 million units
That means that the as of week 84, the PS5 has sold lifetime ~20.458 million units while XBS consoles have sold lifetime ~15.225 million units. That brings the ratio down to 1.34 : 1 in favor of PS5. Week 78 had that ratio at 1.35 : 1 in favor of PS5.

Something to consider, some number of XBS-X SOCs are going into XBS-X blades in data centers, so MS aren't selling as many XBS consoles as they could if they weren't pushing for cloud gaming.

This made me think that Sony may be expecting that there will be global supply constraints on components needed to make PS5s that will exist for potentially years. This could be additional impetus for them accelerating their timeline for releasing 1st party games on PC.

Launch aligned this means that the PS5 is selling worse than the PS4 while the XBS consoles are selling better than XBO.

NOTE - this is not a reflection of demand, it is primarily due to supply issues with demand still being higher than supply.

SB

What the hell? Xbox outsells Playstation in Japan. I hope Sony have bunged Squeenix a huge wad of cash for FF16 exclusivity, or they might be rueing those lost sales.

Yes, xbox s x/s has outsold the PS5 for one whole week, during which PS5 has likely been supply constrained :)
the Xbox Series console family sold 6,695 units during the period June 13-19, which eclipses PS5's 3,035 sales.

I'm not sure supply constraint entirely explains it seen as Series X which should also be constrained, outsold it by over a 1000 as well.

The Xbox numbers are absolute lowest bound numbers. They were based on PR words such as "fastest selling xbox". As such they do not give actual numbers but only lowest bound limits.

Many see that number as not being accurate and so the gap is substantially closer than that.

We won't know the actual Xbox numbers because Microsoft does not report sales numbers.

Oh both are constrained but at the same time they have around equal shipments. People tend to buy whatever becomes available to shift to next gen gaming.
It is a whole different story compared to when both consoles have more than enough and people just make a choice.
So expect a lot of consumers who were more likely to buy a PS5, buying whatever becomes available.
