No they are going to sue anyway. The FTC can't really do anything but sue. Then it will go to court and the FTC will have to prove that MS made promises that it didn't keep or aren't in the process of keeping. LIke others have said in this thread there are no public statments that MS will keep all Zenimax/bethesda games on other platforms. Just like there is no promise here to keep any activision game on the platform. Ms has only said they intend to. At the end of the day MS doesn't own Playstation and can't release any game they want on playstation. They have to enter contract negotiations with sony and come to an agreement and then release the game. So MS would never promise to do something that relies on another partyintresting.. so if MS goes back on their word they will sue and block? Is that the wording here?
How do you block mergers after the deal closes?
You try and make MS sell some or all of the company they bought like the UK or EU did to Meta with regards to gifyHow do you block something that's already happened if the case doesn't get resolved until post merger? Unmerge? An excuse for a big ass fine?

It really depends on who gets voted in. if we get another 4 years of Joe and the feels over the law folk then we will have to hope the courts stay sane. If the republicans come into the power they will likely be upset that microsoft donated more to the democrats than to them and MS will either pony up to political campaigns or the republicans will saber rattle. But since this is a biden admin thing I am sure they will quickly drop it cause it was started by the other guysRather painfully, especially since several election cycles and employee personnel will likely change several times over. It probably involves a lawsuit.
The FTC wont win so it doesn't really matter to MSI wonder if big tech firms are now enjoying getting double crossed by the very own political establishment that they looked up to ? How does it feel for them to get politically outsmarted by the likes of Elon Musk ?
It's not just the FTC and the US court that they have to worry about ...The FTC wont win so it doesn't really matter to MS
From my understanding based on quick listen of hoeglaw this actually makes it more awkward for MS.intresting.. so if MS goes back on their word they will sue and block? Is that the wording here?
Unfortunately unions don't really mean much as there is barely a union force in the US. Tons of companies just fired tens of thousands of workers at once, hell Elon just laid off majority of Twitter workforce and it doesn't really mean a thing as far as company wide consequences. The more powerful an entity you are the less accountability you need to have. The US political takes I see on social media is really quite something, where they ignore the reality and the vast improvements made with Microsoft and worker unions. Total ostriches and peacocks. So much for show.

so basically, if I understand this correctly, they are stuck in perma limbo between acquiring and not acquiring ABK and the FTC is just going to wait until MS gives up and drops the merger? From my understanding based on quick listen of hoeglaw this actually makes it more awkward for MS.
If FTC actually tried to out right block would go to court and would make it easier for MS to put it to judge.
This way it basically ties it up in red tape.
(my interpretation of what he's said)
So who knows how this pans out and how long it will take etc at mo.

It's too late to make amends, they should've known better than to dismantle the last administration so even the courts might get political too now ...Not to get political, but I really don't get why some think it's great to keep shooting themselves in the foot when it comes with actually improving US companies. They're so dead set in ideology that they would rather have far worse practical realities.
If you get paid to hit nails with a hammer what do you do when there are no more nails to hit ? That is why you always have to insure the issue exists so that you can claim you will come in and fix it.Not to get political, but I really don't get why some think it's great to keep shooting themselves in the foot when it comes with actually improving US companies.
