There are two ways to look at what constitutes a "DX9" game. Does it use DX9-level shaders for gimmicks? Or does it use DX9-level shaders as a fundamental element of the game?
I see nothing to suggest that the Tomb Raider effects are anything more than a gimmick. So, by one definition, I could easily say that Tomb Raider is
not truly a DX9 game.
