You're equating modchips with piracy. While this might be the case most of the time, there are significant noninfringing uses for a modded console. Penalizing people who are legally modding because of pirates is not fair. You can still prosecute pirates without making modchips illegal.
BTW, I think a similar law was passed in Australia, so this is not a case of Italy being lenient, but rather of the US being skewed toward protecting copyright holders at the expense of the public.

Buy an american ps2. Simple and not that much more expensive.
Modchip -> Less sales -> Less games...
If you want more rpgs to be released in Europe, buy more rpgs..simple.
