So you say that the prisoners at Guantanamo Bay are in a judicial vacuum, and hence the U.S. can do whatever they want with them.

This is exactly the objection the rest of the world has. Either they are prisoners of war and has to be treated according to the Geneva Convention or the are no more than mercenaries and then should be tried as war criminals, as was done with the post-Bosnia fall out.

In the former case the prisoners should be free by now, in the latter they should have access to legal counsel. Anything less is a violation of human rights.
