Found this article about what's going on in Louisiana, but found out that is also afects Texas and Mississippi also. Imagine, cops searching your house without warrants.

Court: Evidence can be used from some warrantless searches

A federal appeals court has opened the door for police officers in three states to search homes and buildings for evidence without a warrant - a ruling that two dissenting judges called "the road to hell."

Agreed.

In the majority opinion, Judge William Lockhart Garwood wrote that any in-home encounter poses a risk to police officers, even if it is simply to interview someone.

Agreed that it does pose a threat, but what they are talking about isn't interviewing someone, they are talking about searching a house. Double-speak?

American Civil Liberties Union called the decision dangerous.

"This decision is the latest roll-back of safeguards to protect the people from being at the mercy of a police state," said Joe Cook, executive director of the ACLU of Louisiana. "Allowing law enforcement to search homes without probable cause or any warrant makes a dramatic and dangerous departure from one of our most fundamental American freedoms."

I agree, but this shouldn't suprise anyone, especially with Patriot Act's I and II.

Not sure how to interpret this. You implying the 4th amendment needs to go? If so, why?
:D linthat22's title of saying goodbye to the 4th amendment cause me to make an off the cuff remark. Take it as a joke. The constitution has endured many presidents, their agendas, and the courts who interpret laws, it will survive this one too, and future ones.

The Constitution doesn't "simply survive", it endures through social struggle. It's taking incredible amounts of dedication and sacrifice, and if people allow it to fall apart, it will. I think history has shown us that no piece of paper, no matter how noble the words written on it are, is indestructible.
 
Clashman, I see what your saying, and i am generally of the same opinion. But I believe there are cycles when the courts who interprets the constitution swings from one side to the other, back again in a few years. Much has changed since 9/11, a few years of one extreme will most assuradly lead to that extremes disfavor by the public. I hope this makes sense, im almost done my grave yard shift, and plan on going to bed. ;)

Lowered the requirements for probably cause, zero tolerance, etc. :rolleyes:
Sounds to me that if he managed to do that, there's a bigger problem with the separation of powers.
 
Holy shit d00d, this is very, very sad. Yes the Constitution will survive, but I do wish that the people of America can grasp what is happeneing to their freedom.
 
It is your personal freedom to break the law as you please. Cops, be warned. You must not interfere with the breaking of the law! It's not as clean-cut as that, but this is a wall that we might have to cross with the threat of terrorism.

Our mistakes in the past led to thousands of deaths, and now we unfortunately need a tighter policy for a while until the threat goes away. The 4th amendment is vital, but the Patriot Act must stand.. at least for now.

You should say portions of the Patriot Act should stand. Not all, I've done the research and have spoken to our County Commission, it's not all good and it's not all bad. Sorry, just being picky, not your fault.
