It was more a fact that they didnt get a cut from the movie. Tolkien sold the movie right a long time ago, while still alive. So the estate didnt get crap out of it directly. Tolkien sold the movie rights to Saul Zaentz in the late '60s, who in turn sold them to New Line (I believe). But the estate has certainly seen a sharp increase in book sales and movie tie-in merchandise.
