The FIA International Court of Appeal in its own judgement was unable to prove that the team acted in bad faith. B.A.R Honda therefore remains unclear as to the basis for such a severe penalty.

Yeah, they weren't acting in bad faith. They had more fuel embarked in the cars, simply because they use the F1s to do their shopping after their work. And since, obviously, there's no competent pit stops between the BAR operations centre and their local Supermarket, they had to add another fuel tank. QED.
