dave pp is fine as long as the program asks for it. If the driver deciedes on its own to use fp 16 that is not legal.

In some cases it is legal.

Looks quite good, IMO. But the better graphics get, the more outstanding the lack of proper shadowing becomes.
I don't think you can tell whether there were some complex shaders used. Usually, a good shader effect is a very subtle one.

I agree but in this case, we can call them excellent shaders since they're almost invisible! :D
leaving "classical" vertex sharder apart, today's subtle pixel shaders are used for shadowing (soft, fade, etc), various lighting effect...
Yes it's great but it's hardly "advertisable" like they did:
