I thought the idea was that after the copyright was up, people could then make their own derivative works. Movie companies have certainly made use of "out of copyright" material (e.g. Shakespeare, Austin, Gilbert&Sullivan, Homer, Mozart, Beethoven.. .etc etc) but perhaps some feel that their work is somehow more special?
