HardOCP has spent close to $200,000 since February of last year in order to keep this article in question online. The law firm of Storm & Hemingway have been incredible to work with and are truly brilliant when it comes to legal strategy. Not only that, they are simply good folks that care about their clients and it has always shined through that they had our best interest at heart. Tim Roberts Emails Company On Result

We've just received a leaked internal email that we can assume comes from Tim Roberts, long missing in action.

All,

I just wanted to send a note out to everyone regarding the claimed HARDOCP victory today. Kevin and I discussed whether it made since for the company to continue pursuing this action which was non-monetary and we both felt it was a bad decision from the start and a waste of our time and efforts to the Phantom Project. This is why we didn't pursue the case here in Florida which the Texas judge said if we did he would move the case to Florida and not award this victory to them.

As Larry Flint stated, our nation's 1st amendment right allows for people to abuse the media and that's the price we pay for free speech which is well worth it. Let them take their small victory and let us put our heads down and focus on work and they will eat crow from our success.

If he runs his company with the same foresight that email indicates he precipitated this lawsuit, Infinium should really take off. *cough*
 
Thank god that's over (well mostly), HardOCP was starting to look like CourtTV or Larry King every other week. :?

I am glad HardOCP won though; freedom of speech and all that.

Sorry, but it seems pretty clear cut to me and a no-brainer. Infinium brought suit, so they forced Kyle to hire lawyers...if they want to call it quits now they owe him for the cash he shelled out for the legal.

Besides, I'm pretty sure it's the law. ;)
Kyle WILL push for the legal fees, I'm sure of it.

I agree, I just think Infinium will be bankrupt and out of business before Kyle's legal representation is able to recoup the money. Of course they could always try going after Tim Roberts personally, but that only complicates the legalities.

Don't get me wrong: I hope Kyle gets back whatever he's spent or owes defending his site.
 
Heh, I kind of like the idea that Kyle is going to bankrupt Infinium and mebbe Tim Roberts personally just by going after what he is entitled to...I think it'll play out well for him. ;)
 
A big THANK YOU to all you guys that have stood behind us on this issue for the last year. It feels good to be out from under this finally, and doubly good to walk away with a solid moral victory. Again, thank you all.
 
I'm still boggling over a website *having* an extra 200k laying around to spend on something like this. Or is that just the bill (i.e. hasn't been paid) and they are counting on getting it back by judgement?

you have no idea how much a site can make. Some sites are big $$$$$$.

As for the victory itself, I've not really been one of Kyle's biggest fans (he's got a tendency to post rather insensitive things at times, like implying dyslectic people are stupid as he did a couple years ago which kinda pissed me off), but I'm glad he won this time. Tim Roberts looks like a grade-A scumbag and liar, and to have him get away with squashing someone for reporting public knowledge would have meant wronging all that is good and decent.

Anyway, I'm amazed the obvious scam that is Infinum hasn't collapsed in on itself already. Maybe that stock pump-and-dump scheme gave them a short extra lease of life, who knows.
